Representative Cases

  • Motorist was stopped by police for illegal right turn. When his name was run it appeared to arresting officer that there was an outstanding felony warrant against him for child molestation. Motorist said he did not think there were any warrants out for him. He was taken to jail and booked. In booking process there were indicators he was the felony fugitive, but his CII number (from Live Scan fingerprinting in FBI/DOJ databases) suggested his fingerprints were different from the fugitive's. Motorist did not state during booking process that he was not the person with the warrant. In fact, he signed a form that said he did not contend he was not the person with the warrant. He was jailed for five and a half days before the DA discovered by finding a photograph in archives that he was not the felony fugitive. Motorist contended the police were required to investigate further based on the difference in CII numbers and for other reasons.


  • Small child with disabilities and mixed racial background claimed school discriminated against him.
